Who we are, and what this is
E-Comets SAL is a Lebanese company registered in Beirut. These terms are the agreement between E-Comets and the merchant who opens an account, and they govern the use of the E-Comets platform: the merchant admin, the hosted storefront, and every service reachable through them. By creating an account, or by continuing to use the platform after a new version of these terms is published, you accept the version in force on that day. Each version is dated, numbered, and never edited in place, so the version you accepted remains readable.
Your account
You register with accurate information: a real business name, a working email address, and a phone number that reaches you. One account holds one organization and its store. You are responsible for what happens under your account, including what your staff members do with the access you grant them; the platform lets you limit each staff member to the areas they need, and granting broader access than someone needs is your decision to make and yours to answer for. If you believe your account is compromised, tell us through the contact page and change your password immediately.
The platform is for businesses. The person opening the account must be at least eighteen and must have the authority to bind the business they register; by opening it they confirm both. An account is not transferable: it cannot be sold, lent or handed to another business.
The service
E-Comets provides the software: a storefront your shoppers visit, an admin where you run the store, and the machinery between them, including order tracking that records fulfilment and payment as two separate facts. We work to keep the platform available and fast, and we schedule maintenance for quiet hours where we can, but we do not promise uninterrupted availability and these terms do not include a service-level guarantee. What we do promise: your data is not lost by our negligence, incidents are worked until resolved, and if a platform defect breaks your store, fixing it is our job and costs you nothing.
Your store and your content
Everything you put into your store stays yours: your product content, your images, your prices, your customer list, your order history. You grant E-Comets the licence needed to host and serve that content to your shoppers, and nothing more; we do not use your catalogue or your customer list for our own marketing and we do not sell either to anyone. You are responsible for having the rights to what you upload and for the legality of what you sell under Lebanese law and the law of anywhere you ship to.
Your shoppers
The sale is between you and your shopper. E-Comets is not a party to it: we do not hold your inventory, we do not carry your goods, and cash collected at the door moves between your shopper, your courier, and you. What your shopper is promised on your storefront — prices, delivery times, the return promise at the door — is your promise, and honouring it is your obligation. The platform records those events truthfully; it does not perform them.
Fees and billing
Plans are priced in US dollars and billed monthly, in advance, at the price published on the pricing page on the day the month begins. There is no setup fee, no per-order fee, and no share of your revenue. You pay by Visa or Mastercard through MontyPay, a licensed payment service provider. The card is entered on MontyPay's secure page and never passes through E-Comets; what reaches us is a payment reference and the result. Your plan renews each month on the same card until you cancel, and every charge is matched by an invoice sent to your account email, so any line on your card statement can be traced to the month it paid for. A merchant who cannot use a card may ask, through the contact page, to settle by Whish, OMT or bank transfer against an invoice instead.
If a payment fails or an invoice goes unpaid, we tell you before anything changes: first a notice with time to put it right, then a restriction of the admin, and only after continued non-payment a pause of the storefront. Your data is not deleted for non-payment. Taxes required by Lebanese law, where applicable, are shown before you pay and on the invoice.
The trial, and leaving
The trial is fourteen days, needs no card, and ends by itself: if you do not choose a plan, the account closes without any charge and without your data being handed to anyone. When you choose a plan, the first payment is taken that day and your month runs from it. Paid plans are month-to-month; you may cancel at any time from the admin or through the contact page. Cancellation takes effect at the end of the paid month, the card is not charged again, and no further invoices are issued. After cancellation your data remains exportable for sixty days, after which it is deleted from the live systems.
Data
How data is collected, stored, protected and deleted is the Privacy document's job, and it is part of this agreement. The short form: your shoppers' data belongs to your relationship with them, we host and process it on your instructions, and each store's data is isolated from every other store's at the database layer.
What the platform may not be used for
You may not use E-Comets to sell goods that are illegal under Lebanese law, counterfeit goods, or goods you do not have the right to sell; to deceive shoppers, including fake reviews written as real ones or prices that change at the door beyond what was stated; to send spam; or to probe, overload, or interfere with the platform itself or with other merchants' stores. We may suspend a store that does any of these, and for illegal goods or fraud we may do so without prior notice.
What we are liable for
If the platform causes you loss through our fault, our liability is capped at the fees you paid us in the three months before the event. We are not liable for indirect losses: lost profits, lost data you chose not to export, or the consequences of your own promises to your shoppers. Nothing in this clause limits liability that Lebanese law does not allow to be limited.
Suspension and termination
You can leave at any time; clause 7 says how. We can suspend or terminate an account for breach of these terms, following the notice ladder in clause 6 for payment matters and clause 9 for misuse. If we ever discontinue the platform entirely, you get at least ninety days' notice and your data stays exportable for that whole period.
How the service is delivered
Nothing is shipped and nothing is delivered to an address. The service is access: the admin opens for you the moment your email is verified, your storefront is reachable the moment you publish it, and the capabilities of a paid plan unlock the moment MontyPay confirms your payment, usually within seconds. If a payment is confirmed and the plan has not unlocked within an hour, tell us through the contact page and we fix it or refund it under the Refund and cancellation policy. There are no customs duties, no delivery fees and no delivery windows anywhere in this agreement.
Our platform, our name
Clause 4 says what is yours. This clause says what is ours: the platform software, its design, its documentation, the E-Comets name and mark, and the themes and templates we provide. You receive a licence to use them to run your store for as long as your account is open, and nothing more. You may not copy, resell, reverse-engineer or rebrand the platform, or present it as your own. You may say, truthfully, that your store runs on E-Comets.
Couriers, payment providers and other third parties
Some of what happens around your store is done by others: the courier you choose carries the parcel, MontyPay takes the card payment, Meta serves the advertising you measure through the platform, and the hosting providers in the Privacy document keep the servers running. Each of them works under its own terms, which apply to their part of the job. We choose them with care and we answer for how the platform talks to them, but we do not run them: a courier's delay, a bank's decline or a social network's outage is theirs to fix, and a dispute about their service goes to them first. Links from the platform to outside sites are provided for convenience and are not an endorsement.
Claims that come from your store
The sale is yours, so a claim that arises from it is yours too. If a third party, including a shopper or an authority, brings a claim against E-Comets because of what you sold, what you promised, content you uploaded, or a breach of these terms by you or your staff, you will cover the loss, including reasonable legal costs. We will tell you promptly, let you lead the defence where that is sensible, and not settle anything in your name without your agreement.
Events beyond anyone's control
Neither of us is in breach of these terms for a failure caused by something neither of us could reasonably prevent: war or civil unrest, a general power or telecommunications failure, a natural disaster, an epidemic, or an act of government. Obligations pause for as long as the event lasts and resume when it ends. Two things do not pause: clause 6 of the Refund and cancellation policy still credits a day your storefront could not take orders because of a failure on our side, and your data stays exportable throughout.
Mistakes on this site
If a price, a limit or a description on this site is published in error, we correct it when we find it. Where you have already paid against the wrong figure, we tell you, and you choose: keep the plan at the corrected price from the next month, or cancel and have the charge refunded in full. We never apply a correction to a month you have already paid for.
Legal housekeeping
If a court finds any clause of these terms unenforceable, that clause is read as narrowly as needed and the rest stand. If we do not enforce a clause on one occasion, we have not given it up. These terms, the Privacy document and the Refund and cancellation policy are the whole agreement between us about the platform, and replace anything said before them. You may not assign this agreement to another business; we may assign it only to a successor that carries on the platform under the same terms, and we tell you if we do.
Governing law
These terms are governed by Lebanese law. Disputes that cannot be resolved between us belong to the courts of Beirut.
Changes to these terms
When these terms change, a new numbered version is published on this page with its date, and the change is announced in the admin. Continued use after the date of a new version is acceptance of it. Earlier versions remain reachable, so what you agreed to on any given day stays provable. Questions about any of this reach a person through the contact page.
